This week, the United Kingdom’s Supreme Court ruled that the “concept of sex is binary,” thereby making the legal definition of a woman to be someone born biologically female. Sex and gender as binary is demonstrably and scientifically false. Humans, like countless other species, can be born with a diversity of gender and sex characteristics. The determination that sex and gender are both equivalent and binary invariably strips trans people of fundamental human rights to autonomy and freedom of expression, it undermines the existence of intersex people, and it ends up harming even cisgender people.

 

Human brains do not have either “male” or “female” functionings and patterns connected to the sex we are assigned at birth. We are all a mosaic. Within the intersex community alone, there are at least 40 known variations of chromosomal arrangements that affect genitalia, gonads, and hormone production. Moreover, the existence of a gender binary traps even cisgender men and women into gender essentialism and inequality. Conservative movements like MAGA seek to bring gender dynamics back to the 1950s. We are already seeing a rise in women romanticizing the stay-at-home "tradwife" lifestyle with complete economic dependence on their boyfriends or husbands.

 

In the U.S., the Trump administration has spent its first few months stripping away rights for trans people, including an executive order persecuting trans athletes and declaring gender binary. The administration is currently battling the state of Maine, whose governor, Janet Mills, has refused to comply with his anti-trans executive order. The reversal of recognizing trans people and embracing gender diversity will result in thousands of people missing out on equal pay and sex discrimination rights. It will also increase public hostility towards trans and gender nonconforming people.

 

This ruling is not just about legal semantics, it is about power, control, and oppression of trans rights and people. We must now, more than ever, fight against transphobic and sexist policies and continue to fight alongside the trans community. Trans rights are human rights.
